Family reunification
CONTINUE DOWNFamily reunification is a process by which a foreign citizen legally residing in Spain may request to be reunited with his/her spouse or common-law partner, minor or adult dependent children, as well as with his/her parents, in some cases.
In order to benefit from family reunification, it is necessary for the applicant to hold a residence permit in Spain, whether for work, studies, roots… In addition, the family member to be reunited must meet certain requirements, such as, for example, not having a criminal record.
Schematically, the requirements for family reunification are the following:
- To be the holder of a residence permit in Spain for reasons of employment, studies, roots, among others.
- The family member to be regrouped must be the spouse or common-law partner, minor or adult dependent children, as well as their parents in some cases.
- Have sufficient economic resources to guarantee the welfare of the family member arriving in the country. This means that the applicant must have regular and sufficient income to cover the costs of lodging, maintenance, among others.
- To have adequate housing for the accommodation of the reunited family member. This housing must meet the minimum conditions of habitability and comfort.
- Present the necessary documentation to prove the relationship with the family member to be reunited. This includes marriage certificates or document that accredits the couple’s relationship, birth certificates of the children, among others.
- Not having a criminal record or being in an irregular situation in the country.
Financial means for family reunification:
- For family units that include two members (regrouping and regrouped) a monthly amount of 150 % of the IPREM is required, which this year 2023 amounts to 900 euros.
- For each additional member, 50% of the IPREM must be added, i.e. in this year 2023, 300 euros.
It is important to note that the requirements for family reunification may vary depending on the type of residence authorization of the applicant, as well as the personal situation of each particular case. For this reason, we recommend that the process be carried out with the advice of a lawyer expert in the process.
