Indemnified extinction of the employment contract by the worker

CONTINUE DOWN Arrow down

The indemnified extinction of the employment contract by the worker is a legal procedure by means of which the latter decides to terminate his or her employment relationship with the employer unilaterally.

What does it consist of?

An employee decides to terminate his or her employment relationship due to working conditions that he or she considers unacceptable, such as harassment at work, discrimination, non-payment, serious non-compliance with occupational health and safety regulations, among others.

It is important for the employee to properly document the working conditions that he/she considers unworthy, as this may be crucial to support his/her case in case it is necessary to go to legal instances, such as labor courts, to claim compensation or defend the legitimacy of the termination of the contract.

In addition, it should be noted that the company cannot retaliate against the worker for his decision, because it would be understood that they are violating the right to indemnity.
