Workplace Accident
CONTINUE DOWNWorkplace accidents are unfortunate events that can happen in any workplace, but it is important for workers to know their rights should they occur.
First, it is important to understand that any accident that occurs in the workplace, regardless of severity, is considered a work accident and must be reported to the employer and the employer is obligated to report it to Social Security.
The worker is entitled to receive adequate and timely medical attention. In addition, if he/she needs to be absent from work for a period of time due to an injury, he/she is entitled to receive a temporary economic benefit from the Social Security. This benefit is known as “Temporary Disability” and is provided to cover medical and living expenses during the time the worker is absent.
If the accident at work is serious and the worker is permanently unable to work, he/she is entitled to receive compensation from the employer. This indemnity covers medical expenses, lost wages and damages suffered by the worker due to the work accident.
It is also important to emphasize that workers have the right to a safe and healthy working environment. The employer is obligated to provide the proper tools and equipment for the job, and must ensure that employees receive the necessary training to perform their work safely.
What if my boss refuses to recognize my sick leave?
If your boss refuses to recognize your sick leave, the first thing you should do is file a claim with the Social Security, which is the entity responsible for guaranteeing the benefits and allowances that workers can enjoy, in case of events such as sick leave.
To file the claim, you must provide the medical documentation that justifies your sick leave, including the medical certificate and any other document related to your state of health. Social Security will review the documentation and determine whether you are entitled to sick leave and what type of benefits you should receive.
If it is determined that you are entitled to sick leave and your employer still refuses to recognize it, you should seek legal advice from an attorney specializing in labor law. The attorney will assist you in filing a lawsuit against your employer for breach of contract and will claim compensation for lost wages, damages suffered and other expenses related to the denial of your right to sick leave.
