The Family reunification is a process by which a foreign citizen who is legally resident in Spain may apply for a meeting with his / her spouse or de facto partner, minor or dependent children, as well as with his / her parents, in some cases.
In order to be able to benefit from family reunification, it is necessary for the applicant to have a residence permit in Spain, whether for reasons of work, studies,... In addition, the family member who wishes to regroup must meet certain requirements such as not having a criminal record.
Schematically, the requirements for family reunification are as follows:
- To be the holder of a residence permit in Spain for reasons of work, studies, arraigo, among others.
- The family member who wishes to regroup must be the de facto spouse or partner, minor or dependent children, as well as their parents in some cases.
- To have sufficient financial resources to ensure the well-being of the family arriving in the country. This means that the applicant must have regular and sufficient income to cover the costs of accommodation, maintenance, among others.
- To have adequate housing for the accommodation of the regrouped family. This housing must meet the minimum conditions of habitability and comfort.
- To present the necessary documentation to credit the relationship with the family member who wants to regroup. This includes marriage certificates or documents that demonstrate the relationship of the couple, birth certificates of the children, among others.
- No criminal record or irregular situation in the country.
Economic means for family reunification:
- For family units including two members (regrouping and regrouping) a monthly amount of 150% of the IMREM is required, which this year 2023 amounts to 900 euros.
- For each additional member, 50% of the IMREM, i.e. in 2023, would be added 300 euros.
It is important to note that the requirements for family reunification may vary according to the type of residence authorisation of the applicant, as well as the personal situation of each particular case. For this reason, we recommend that you conduct the process with advice from an expert lawyer in the process.
