What is the Social Arraigo and what requirements should be met?
The Social Arraigo is a temporary residence permit for exceptional circumstances that may be granted to foreign citizens who are in Spain for a minimum period of three years and have a contract or employment contract and, either have family ties in Spain or are socially integrated.
The requirements for obtaining the Social Arraigo are as follows:
Not to be a citizen of a State of the European Union, of the European Economic Area or of Switzerland, or a family member of citizens of these countries to whom the system of Union citizenship applies.
It has no criminal record in Spain and in previous countries of residence for offences under Spanish law.
No entry into Spain is prohibited and no country with which Spain has signed an agreement is eligible for rejection.
Not to be within the commitment period of no return to Spain. It has a period of 3 years and applies to foreigners who decided to leave the country of their own free will.
Continued residence in Spain is required for a minimum period of three years. During this period, Spain's absences cannot exceed 120 days.
To have family ties with other resident aliens (registered spouse or partner, ascending or descendants in the first degree and direct line) or to submit a report certifying their social integration issued by the Autonomous Community (or the City Council if the Autonomous Community has authorized it) where it has its home.
To have a contract of employment signed by the worker and the employer, which guarantees at least the minimum inter-professional wage or the wage established, where appropriate, in the applicable collective agreement.
A number of contracts are also allowed in a single or different occupation, working partially and simultaneously for more than one employer.
