What is Spanish Nationality by option?
If you are a foreigner and meet certain requirements, the option is a procedure that allows you to obtain Spanish nationality. In this article we explain everything you need to know about this process.
The option is made on a face-to-face basis before the Registrar of the Civil Registry of the person concerned in Spain or at the relevant Consular Office if he is abroad.
Who has the right to choose Spanish nationality and within what time?
There are several situations which give the right to choose Spanish nationality. For example, persons who are or have been subject to the parental authority of a Spanish have the right to choose. The time limit for the option is two years from the age of majority or emancipation.
They also have the right to choose persons whose father or mother had been Spanish born in Spain, without a time limit. In addition, persons whose filiation or place of birth in Spain is determined after the age of 18 have the right to choose. In this case, the period of option is two years since filiation or birth is determined in Spain.
Finally, persons adopted by Spaniards after the age of 18 are also entitled to choose. The option period is two years from adoption.
If the person concerned is a minor or is disabled, the option is made through his or her legal representatives. If, on the contrary, he is over 14 years old, he will do so for himself, assisted by his legal representatives. Incapacitated persons may make the option themselves if the decision of incapacitation permits. The time limit for making the option expires when the person concerned reaches the age of 20, unless his personal law sets another age for the age of majority.
