Retired no longer has to be a dry jump from work to pension. From 28 August 2026 a new regulation is in place that will extend the possibilities of Compatible pension recovery with continuing work, and even allows more pension to be paid. It is the largest flexible retirement update in more than 20 years. We explain to you what it is and how to take advantage of it.
What is flexible retirement
Flexible retirement is the way that allows a person to already retired back to work part-time, charging at the same time part of your pension. The pensioner maintains retirement status —with their health care and social protection—but is reincorporated into the labour market with a reduced time.
The novelty comes with the Royal Decree 416 / 2026 of 27 Maywhich completely replaces the previous Royal Decree 1132 / 2002, which has been in force for more than two decades; and entered into force on 28 August 2026. It is part of measures to promote active ageing and facilitate voluntary stay on the labour market.
Key developments in RD 416 / 2026
1. More working time: from 33% to 80%
In the past, compatibility was limited to days between 25% and 75%. Now the range is extended: you can work between the 33% and 80% of a comparable full-time worker's day. The pension is reduced in proportion to the day you make, and you continue to charge the rest.
2. More pension to be reinstated: the incentive
This is the great novelty and the most attractive. If activity employed first started at least six months later if the pension has been caused, the amount of the compatible pension is increase according to the day:
- 25% additional if the day is between the 55% and 80%.
- 15% additional if the day is between the 33% and 55%.
This increase is calculated on the amount of the pension that was being received before access to flexible retirement.
3. The self-employed, at last inside
So far flexible retirement was reserved for employed employment. The RD 416 / 2026 incorporates self-employment:: a pensioner may make his pension compatible with an activity as an autonomous person.
There is a specific requirement: not having been discharged as self-employed during the three years immediately preceding the fact of retirement. In this case, the compatible amount of the pension shall be 25% of the pension granted.
4. Improvement on return to full retirement
When the pensioner returns to full retirement after the flexible period, if he agreed involuntary early retirementthe pension is recalculated and may be improved, depending on the period of credit.
What to consider before deciding
- The contributions during flexible retirementas a general rule, do not increase the future pension: they serve to maintain the social protection of the period of activity, not to make up the final pension.
- The complement by or to reduce the gender gap is adjusted in the same proportion as the pension (although the minimum supplement is excluded).
- Flexible retirement is incompatible with certain benefits, such as permanent incapacity resulting from the activity carried out after retirement.
- Flexible retirements before 28 August 2026 are governed by the previous rules.
Flexible, active or delayed retirement?
They should not be confused, because they are different figures:
- Flexible: You're already retired and you're back to part-time, taking part in the pension.
- Active: compatibility of work and a percentage of pension without having previously reduced your activity, meeting certain requirements.
- Delayed: you voluntarily delay retirement beyond the legal age in exchange for incentives (an additional percentage, a single payment or a mixed formula).
The same RD 416 / 2026 also improving delayed retirement, adjusting the call «mixed option» which combines additional percentage and single payment.
