1. Introduction
When a company recognizes that dismissal is inappropriate and pays compensation, many workers think that there is no longer anything to do. But such compensation may be miscalculated, and dismissal may hide a retaliation for having claimed. Demand and reach until the day of trial can multiply the final amount, provided the agreement is closed with guarantees.
2. The company recognizes that the case is not closed
The company can recognize the inprovenance of the dismissal and pay the compensation of 33 days per year. But the worker may also challenge the dismissal if he considers that:
- The compensation has been calculated by a lower than actual wage, for example because he was not paid in accordance with his professional category or the overtime was not included.
- The dismissal is actually nilbecause it responds to a retaliation or violates fundamental rights.
The time limit for filing for dismissal is 20 working days, and advice should be given immediately.
3. Dismissal after claim: the guarantee of indemnity
To claim payment of the overtime or the corresponding professional category under the agreement is a right. If the company responds by firing the worker, this dismissal may violate the guarantee of compensationwhich is part of the right to effective judicial protection under article 24 of the Constitution and protects workers from reprisals for claiming their rights.
Such dismissal may be declared null and void, with readmission and processing wages. This is the possibility that strengthens the worker's negotiating position.
4. Trial day agreements: the role of the judge
Many dismissal proceedings end in agreement on the same day of the trial. Before entering, the counsel of the Administration of Justice attempts conciliation, and the judge himself often asks the parties whether they can reach an agreement before the hearing begins. That moment, with all the evidence prepared, is when the company really values the risk of an unfavourable sentence.
The agreement reached before the court has executive power: if one party fails to comply, the other party may demand compliance as if it were a sentence.
5. How to guarantee collection: pay before signing
A deal is only worth it if it's charged. One formula that gives security to both parties is that the company transfers the money and, once received in the worker's account, it signs the agreement before the counsel of the Administration of Justice or the judge. Thus:
- The worker doesn't give up anything until he has the money.
- The company has the tranquility that the worker will sign, because the commitment is brought before the court.
And, as in any agreement, it is essential that it be well documented and signed by those who can force the company. We explain why in our article on the agreements signed by the legal representative of the company.
6. Real case
The video is recorded at the exit of the City of Justice of Castellón. One month after claiming payment of overtime and its professional category under the agreement, our client was fired. The company recognized the inorigin and paid him compensation of less than 2,000 euros. We filed a lawsuit and, after almost four hours in court, an agreement was reached to charge more than 13,000 euros, 13 times more.
No antes.

8. Frequently asked questions
9. Conclusion
