You no longer need a registration number to announce your apartment at Airbnb or Booking? Part of it is, and that nuance is the one that is creating the most confusion. The Supreme Court has annulled the Single Landing Register (the well-known NRUA), but the sentence does not remove controls on tourist rental: returns them to the autonomous communities. If you rent per season or for tourist use in Barcelona, this is what changes and, above all, what does not change.
What exactly has the Supreme Court decided?
The Judgment No 620 / 2026 of 19 May (Third Chamber, appeal 143 / 2025) partially the resource brought by the Generalitat Valenciana against the Royal Decree 1312 / 2024which regulated the Single Lease Registration procedure and created the Single Digital Window, in force since 1 July 2025.
The word partially: the Royal Decree has not disappeared. What falls is the single state registration procedure.
The Supreme's reasoning is competitive, not substantive. The State had no title to create a national register that would overlap existing autonomous registers in the area of tourism and housing. The Court rejects the titles invoked by the Government one by one:
- Management of public records (Article 149.1.8 EC): It does not serve, because it is not a question of registering a contract or a charge of control against third parties, but of a materially administrative record linked to housing and tourism skills.
- Bases of economic planning (art. 149.1.13 EC): Nor, because the regulation is so detailed that it goes beyond what can be considered. «bases».
- Basic conditions of equality (art. 149.1.1 EC): Dismissed, too.
The Supreme also clarifies an important point: although the Royal Decree stated that it was adopted in application of the Regulation (EU) 2024 / 1028the European standard does not require the registration to be national nor alters the internal division of powers in each Member State. In fact, it allows national, regional or local procedures to coexist, provided that the same unit is not subject to more than one.
A revealing detail: the Council of State had already warned unanimously in its opinion 1926 / 2024, noting that it was an administrative register «disguised» registration procedure. The Government also approved the rule.
What is annulled and what survives
The following shall be annulled:
- The State single registration procedure and the obligation to register in the Register of Property or Furniture to obtain the number (NRUA) necessary to be announced on platforms.
- In particular, Articles 1 (for registration), 2 (f), 2 (i), 2 (j), 5, 6 (for registration), 8, 9, 10, 12 (b) and 12 (c), the second additional provision and the first final provision, in addition to any other mention of the single registration.
- The obligations specifically referred to these precepts, including the annual information statement linked to the State registry.
Survives:
- The Single Digital Lease Window (Article 7), covered by State coordination competence and required by the European Regulation itself to ensure interoperability.
- To the data transmission obligations of online platforms.
- Data transmission for statistical purposes (Article 11), under State competence in statistics (Article 149.1.31 EC).
Since when? From published in the BOE on 8 June 2026the registration is no longer required to obtain the state registration number. The doctrine has then been reiterated in several subsequent judgments (649 / 2026, 669 / 2026 and 697 / 2026).
What I feel being mandatory (and here is the risk)
This is the point where the most owners can be wrong. The judgment does not create a legal vacuum: returns the leading role to the autonomous communities. They remain fully in force:
- The autonomous license and registration. In Catalonia, the corresponding tourist capacity remains essential. More than 90 per cent of the communities already had their own compulsory registration before the Royal Decree.
- Municipal regulationsespecially restrictive in Barcelona.
- The registration of travellers via SES.HOSPEDAJES (Royal Decree 933 / 2021), with data sent within 24 hours of arrival and without a minimum threshold.
- The faculty of the owner community to limit or prohibit tourist floors with the favourable vote of three fifths of the owners, since the reform of the Horizontal Property Act of April 2025.
- Tax obligations associated with the activity.
- In Catalonia, Law 11 / 2025which redefines the seasonal rental and requires a documented certification of the purpose of the contract.
That clear: the Supreme has eliminated a procedure, not regulation.
What if I already paid for the record? What if I was denied it?
Two common situations that should be analysed on a case-by-case basis:
- Applications denied or pending. With the State procedure annulled, many houses rejected by the State system can redrive their situation through the autonomous route.
- Registered tariffs paid. To date, no specific administrative channel has been allowed to claim the return of the duties and expenses incurred, which requires that the claim be made by the ordinary legal channels. If you've handled the NRUA, it's worth assessing your case.
The Ministry of Housing has announced that it will work in a new state regulation to replace the cancellation, which is expected to be based on the interoperability of the autonomous registers, as proposed by the Council of State.
Frequently asked questions
Do I need the NRUA to announce me at Airbnb or Booking? No. Since the publication of the judgment in the BOE on 8 June 2026, the State registration number has no longer been required. But you do need to comply with the registration and license of your autonomous community.
Does this mean that there is no control over the tourist floors anymore? No. The judgment nullifies a State mechanism for lack of competition, not regulation. The autonomous registers, municipal licences, the registration of passengers and the rules of the community of neighbours remain in force.
Does the Single Digital Window also disappear? No. The Supreme maintains it, together with the data transmission obligations of the platforms and those of statistical purpose.
Can I get back what I paid to process the search? For the time being, there is no administrative channel for return and an individual claim should be assessed.
Does this affect my seasonal contract in Catalonia? The sentence does not alter Catalan Law 11 / 2025, which continues to require documentary evidence of the temporary or holiday purpose of the contract.
