Right to unemployment
The right to unemployment is a fundamental labor right, this right is regulated by Royal Legislative Decree 8/2015, of October 30, which protects workers in case of unemployment. In general, the right to unemployment is granted to those workers who have lost their job involuntarily and who meet certain requirements.
- Have worked and contributed at least 360 days in the last six years.
- Have been involuntarily dismissed, either by objective, collective or unfair dismissal.
- Be registered as a job seeker with the State Public Employment Service (SEPE) and meet the requirements to actively seek employment.
If you meet these requirements, you may apply for unemployment benefits within 15 working days from the date of termination of your contract or from the date on which you were notified of your dismissal.
Once you have submitted your application, the SEPE will review your situation and determine if you meet the requirements to receive the financial assistance. If so, you will be granted a monthly amount that will depend on your previous salary and the time you have worked and contributed.
